A scheme is a legal document by which we may amend, replace or amplify a charity's governing document. A scheme is needed when a charity cannot run effectively in accordance with its existing governing document and the trustees cannot make the necessary changes themselves. The making of schemes is an important way in which the Commission's objective of ensuring that charities are able to operate for their purposes within an effective legal, accounting and governance framework is achieved. The impact of our schemes on charities is substantial and is measured in monetary terms by the effect the scheme has on the application of the charity's income.
Usually, we will make a scheme for one or more of the following reasons:
- To modernise or widen the objects of a charity to allow its income to be applied more effectively for the benefit of its beneficiaries; where the change is substantial the impact will be the charity's gross income for the last financial year;
- To amalgamate charities which leads to savings in administrative costs and a more effective use of charitable funds; the impact will be the last year's management and administrative costs those charities that have ceased to exist;
- To replace a governing document that is inadequate or out of date with modern administrative provisions that enable trustees to administer their charity more effectively; where a completely new governing document is provided the impact will be the charity's gross financial income for the last year;
- To give the trustees new powers or authorise specific transactions which are in the best interests of the charity; the impact for a specific transaction will depend on the value of the transaction.
